“Play to Win with Eggs! Contest”
Official Contest Rules
CONTEST PERIOD:
To enter the Play to Win with Eggs! Contest (the “Contest”) visit www.eggs.ca/playtowin. The Contest commences at 12:01 AM (ET) on January 19, 2009 and will end at 11:59 PM (ET) on March 14, 2009 (the “Promotional Period”) after which time the Contest will be closed and no further entries will be accepted.
ELIGIBILITY:
To enter and be eligible to win a Prize, a person must be a resident of Canada who has reached the age of majority in the province or territory in which he/she is residing at the time of entry into the Contest. Employees, officers, and directors (including immediate family members and members of the same household of such persons, including common law spouses) of Egg Farmers of Canada (the “Sponsor”), its respective affiliates, agents, participating stores, advertising or promotional agencies, suppliers of Prizes and/or materials, or services related to the Contest are not eligible to enter the Contest. The decisions of the judges are final.
HOW TO ENTER:
To enter the Contest: (1) find your unique 12-character PIN code on specially marked cartons of eggs available in participating stores between January 19, 2009 and March 14, 2009; (2) go to www.eggs.ca/playtowin to enter your unique 12-character PIN code and fully complete the online Entry Form with your salutation, full name, full address, daytime telephone number, year of birth, and email address no later than the Contest end date of March 14, 2009 at 11:59 PM (ET); (3) read and accept the Official Contest Rules; and (4) select submit. While supplies last. Limit one (1) entry per unique PIN code. All entrants: Retain your original sticker or insert with unique PIN code for verification if you are drawn as a conditional winner. Please allow 48 to 72 hours for a response.
All eligible entries received during the Contest Period will automatically be entered into a random draw for the Grand Prize on or about March 30, 2009.
No Purchase Necessary. All entries must be received by 11:59 PM (ET) on March 14, 2009 (the “Contest Closing Date”). To enter without purchase you must compose a one hundred (100) word hand-written essay on a piece of 8½” x 11” paper explaining how you like to eat your eggs. Print your salutation, full name, full address, daytime phone number, year of birth, and email address on the same piece of paper and mail it in an envelope to: Play to Win with Eggs Contest (No Purchase Request), OSL Marketing, 5225 Satellite Road, Mississauga, Ontario, L4W 5P9. You will be mailed a No Purchase Necessary sticker containing a unique 12-character PIN number permitting you to participate in the Contest during the Contest Period without purchase and while supplies last. Limit one (1) request per postage-stamped envelope, per household, per week. Each week starts at 12:01 AM (ET) on a Monday and ends at 11:59 PM (ET) on the following Sunday. Requests must be postmarked by February 27, 2009 to ensure there is enough time to process the No Purchase request. The Sponsor will not be responsible for lost, misdirected, stolen, illegible or late requests, or for postage due. Upon receiving your No Purchase Necessary sticker containing your unique 12-character PIN code, visit www.eggs.ca/playtowin and follow the instructions. Requests robotically reproduced or made in any fashion are void. Purchase does not enhance a person’s chance of winning.
ENTRIES:
Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. The Sponsor will not be responsible for late, lost, illegible, falsified, damaged, misdirected, mutilated, garbled or incomplete entries, which will be void. All entries become the property of the Sponsor upon receipt and none will be returned.
PRIZES: There will be a total of fifteen thousand and one (15,001) prizes available to be won (each a “Prize”).
INSTANT WIN PRIZES:
There will be fifteen thousand (15,000) Sport Chek® gift cards and Sports Experts® gift certificates available to be won during the Contest Period. Retail value of the Sport Chek® gift card is $25 CAN. Retail value of the Sports Experts® gift certificate is $25 CAN. Winners from Quebec will receive a Sports Experts® gift certificate whereas winners from all other provinces and Territories in Canada will receive a Sports Chek® gift card. The number of prizes available to be won will diminish throughout the Contest Period as they are claimed. Prizes are not transferable and must be accepted as awarded, with no substitutions of any kind. Sport Chek® gift cards and Sports Experts® gift certificates must be accepted as awarded without any substitutions. Unclaimed prizes will not be awarded. Any difference between the actual value of the prizes and approximated value of the prizes as stated in these Official Contest Rules will not be awarded.
No responsibility is assumed by the Sponsor for any postal mail or overnight delivery returned as undeliverable without a forwarding address. No P.O. Box addresses will be accepted as a valid delivery address. No responsibility is assumed by the Sponsor for prizes after they have been shipped. Sponsor makes no representation or warranty of any kind concerning the appearance, safety or performance of any prize. Winners bear all risk of loss or damages to prizes after delivery.

GRAND PRIZE:
There will be one (1) grand prize available to be won consisting of a trip for the Winner and three (3) travel companions (the “Guests”) to Costa Rica (“Destination”). The trip must be taken between approximately April 15, 2009 and March 30, 2010. Age restriction in effect. Winner and Guests must be at least sixteen (16) years of age or older to participate in the Grand Prize trip. The Prize consists of return economy airfare for four (4) persons departing from a Canadian international airport closest to the Winner’s residence to Costa Rica, accommodation, and spending money. Approximate retail value of the Grand Prize is $12,000 CAN. Actual retail value may vary depending on the city of departure and travel dates. Any difference between the actual value of the Grand Prize and approximated value of the Grand Prize as stated in these Official Contest Rules will not be awarded. Accommodation, unless otherwise stated, refers to stays in 2 and 3-star hotels. Any tour requests must be made a minimum of 60 days in advance. Once confirmed, trip dates and travel accommodations cannot be changed by the Winner; however, travel is subject to availability, blackout dates, and/or change due to circumstances beyond Sponsors' and Administrators' control. Winner and Guests must travel on the same tour dates. Any unused travel will be forfeited. Winner and Guests are responsible for ensuring that all travel papers required for travel to the Destination are in good order, and are valid prior to, and for the entire duration of the trip. Furthermore the prize cannot be used in conjunction with any other promotion or offer and may not be separated. The prize must be accepted as awarded, cash equivalent substitution will not be available. The Winner and Guests must be Canadian residents to qualify for the Prize. The Sponsor, in its sole discretion, reserves the right to select the airline. No frequent flyer miles will be available for this trip. The Winner and Guests are responsible for transportation to and from the designated departure airport, transfers between the destination airport and hotel, and all other expenses not specified herein, including but not limited to: ground transportation, meals, airport taxes, insurance, items of personal nature, telephone, fax or cable charges, personal services and expenses and other incidentals costs. No travel extensions permitted. Airport departure taxes, health and travel insurance, travel vaccines and medications, excess baggage costs, lost baggage, meals, gratuities, room service, in-room movies, mini-bar expenses, car rental and insurance, additional transportation within the Destination, visa costs and any other expenses not specifically mentioned herein are the Winner’s responsibility. Sponsor reserves the right to select seating and accommodation. No responsibility is assumed by Sponsor for any event that is delayed, rescheduled, postponed or cancelled in whole or in part for any reason whatsoever. Grand Prize is not transferable and must be accepted as awarded, with no substitutions of any kind, except by the Sponsor (as defined herein), who reserves the right to substitute a prize of equal or greater value in cash or otherwise if any prize cannot be awarded as contemplated in these Official Contest Rules. Limit of one (1) grand prize for the duration of the Contest Period.
GRAND PRIZE DRAW:
A random draw will be conducted from all eligible entries received during the Contest Period on or about March 30, 2009 at approximately 9:00 AM (ET) in Mississauga, Ontario (the “Draw Date”). Odds of winning will depend on the total number of eligible entries received during the Contest Period. The selected entrant will be contacted by mail, courier or telephone within ten (10) business days of the Draw Date. In the event that a selected entrant cannot be contacted within ten (10) business days by mail, courier or telephone, the selected entrant will be disqualified at the sole and absolute discretion of the judges, his/her entitlement to receive a Prize will be forfeited, an alternate eligible entrant will be randomly selected from the remaining eligible entries, and the above process will be repeated. This process will be repeated until such time as there is one (1) confirmed winner (a “Winner”) and/or no more entries are available. As a condition of being declared a Winner, the selected entrant must first correctly answer without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question to be administered by mail, courier or telephone. In the event that a selected entrant incorrectly answers the mathematical skill-testing question, he/she will be disqualified and another entrant will be randomly selected and the above process will be repeated until there is one (1) confirmed Winner.
HOW TO CLAIM A PRIZE:
If you are identified as a winner of a Sport Chek® gift card or Sports Experts® gift certificate upon entering your unique 12-character PIN code, please allow ten (10) to twelve (12) weeks for verification and delivery of your prize by regular mail post.
Before being declared an official winner of the Grand Prize, conditional winner will be required to correctly answer a mathematical skill-testing question without any kind of assistance, whether mechanical or otherwise, and conditional winner must accept the terms of, and complete a Declaration, Release and Waiver form and return to OSL Marketing (Play to Win with Eggs), 5225 Satellite Drive, Mississauga, ON, L4W 5P9, WITHIN 7 DAYS FROM THE DATE THEY ARE RECEIVED or prize will be forfeited, and conditional winner disqualified. Conditional winner is deemed to have received the Declaration, Release and Waiver form within 7 days of the Sponsor or its agent sending same. Both the Winner and Guests must accept the terms of, and complete the Declaration, Release and Waiver form. You may be required to submit your original sticker, insert or No Purchase Request containing the unique 12-character PIN code for verification if you are a conditional winner. The decision of the Official Contest Judges in respect of all matters pertaining to the Contest, including without limitation, eligibility, validity, contents, and/or disqualification of an entry, shall be final and binding without right of appeal. After you have correctly answered the mathematical skill-testing question and accepted the terms of, and completed the Declaration, Release and Waiver form, you will receive a phone call within 7 business days confirming you are a verified prize winner. Awarding of the prizes is subject to verification and compliance with these Official Contest Rules.
CONDITIONS OF ENTRY:
Entrants (i) acknowledge compliance with these Official Contest Rules including all eligibility requirements and, (ii) agree to be bound by the decisions of the Contest Judges, made in their sole discretion, which shall be final and binding in all matters relating to this Contest. Entrants who have not complied with these Official Contest Rules are subject to disqualification.
Publicity/Liability Waiver/Release to be executed by any conditional winner: among other things, (1) releases the Sponsor and its affiliated companies, agencies, contest prize suppliers and their respective officers, directors, employees, agents, shareholders, officers, directors, members, employees, agents, and assigns (collectively, the “Contest Group”) from all liability with respect to the entrant’s participation in this Contest and the awarding and use of the prize, and (2) provides that the conditional winner agrees to the use of his/her name, address, voices, statements relating to the Contest or the Sponsor, photograph, and other likeness for publicity purposes, without further compensation.
The Sponsors are not responsible for late, lost, damaged, misdirected, mutilated, garbled, illegible or incomplete entries. All entries become the property of the Sponsor and in no case shall be returned to the sender.
The Sponsor reserves the right to prohibit an entrant from participating in the Contest or winning a prize, if, in the sole discretion of the Sponsor, they determine that the entrant is attempting to undermine the legitimate operation of the contest by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or the Sponsor. The Sponsor reserves the right to disqualify any entrant failing to comply with these Official Contest Rules or failing to cooperate in any investigation or inquiry concerning such compliance. Any attempt to deliberately damage any website or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor reserves the unfettered right, in its sole and absolute discretion, to disqualify any entries that it suspects were generated by script, macro, robotic, programmed, or any other automated means, or otherwise violate the Official Contest Rules.
If a dispute arises regarding who submitted an online entry, the entry will be deemed to be submitted by the authorized account holder of the email address provided at the time of entry. Authorized account holder is defined as the natural person who is assigned to an email address by an Internet access or online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address. If you do not have Internet access via a personal computer, your local library or Internet café may be able to provide access to the Internet and a number of Internet service providers and other companies offer free email accounts.
Entrants and/or winners assume liability for injuries caused, or claimed to be caused by participation in the Contest, by the acceptance, possession, or use of any prize awarded, including but not limited to claims/damages for personal injury, or property damage.
CONDITIONAL WINNERS:
If a winner of a Sport Chek® gift card is found to be ineligible, declines to accept the prize, or in the event that a prize confirmation or prize is returned undeliverable, the winner will forfeit his/her entitlement to the prize, and the Sponsor may randomly select an alternate winner for the prize.
In the case of the grand prize, if a conditional winner is found to be ineligible, declines to accept the prize, fails to correctly answer a mathematical skill-testing question, or fails to accept, complete and return a Declaration, Release and Waiver form, or in the event that a prize confirmation or prize is returned undeliverable, the potential winner will forfeit his/her entitlement to the prize and the Sponsor may randomly select an alternate winner for the grand prize. Conditional winners (or parent or legal guardian as applicable), may be required to furnish proof of identification that may include a driver’s license or other form of picture identification.
DISCLOSURES:
Any attempt by an entrant or other individual, to deliberately damage any website or undermine the legitimate operation of this Contest, including but not limited to any fraudulent claims, is a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek remedies and damages from any such individual, to the fullest extent permitted by law, including criminal prosecution. Participants engaging in any of the foregoing activities may be disqualified and will forfeit any prizes won.
Under no circumstances, including negligence, shall the Sponsor, and other Releasees be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of or inability to use the service, or out of any breach of any warranty. This exclusion or limitation of liability will not apply to the extent that any applicable statute prohibits such exclusions or limitations of liability.
The Contest is subject to all Federal, Provincial, and Municipal laws. All entries become the property of the Sponsor and no correspondence will be entered into except with selected participants who will be contacted by mail, phone or by email. By entering the Contest, participants consent to the use of their name and/or photograph in any publicity carried out by the Sponsor or their agents without compensation. VOID WHERE PROHIBITED BY LAW.
Unless entrants otherwise indicate, the personal information gathered about entrants in the course of this Contest will be used solely by the Sponsor and solely for the administration of the Contest and in connection with any publicity relating to the Contest.
The Sponsor reserves the right to modify, amend or terminate this Contest in whole or in part at any time without notice and with no obligation or liability if any factor interferes with its conduct as contemplated by these Rules, subject to the approval of the Régie des alcools, des courses et des jeux. Any litigation respecting the conduct or organization of a publicity Contest may be submitted to the Régie des alcools, des courses et des jeux (“Régie”) for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purposes of helping the parties reach a settlement. Subject to the Rules, only the number and type of prize contemplated by the Rules will be awarded. If more prizes are claimed than are intended by the Sponsor as contemplated in the Rules, the Sponsor reserves the right (among other possible Contest amendments) to cease all related prize fulfillment.
